How many days off can I take for a miscarriage?

Article 1 of the Notice of the Ministry of Labor on Several Issues Concerning the Treatment of Female Employees for Childbirth (Labor Insurance No. 2, 1988) stipulates that if a female employee has a miscarriage within four months of pregnancy, she shall be granted maternity leave of 15 to 30 days according to the opinion of the medical department; if a miscarriage occurs after four months of pregnancy, she shall be granted maternity leave of 42 days. During the maternity leave, wages shall be paid.

Beijing's abortion leave regulations

The maternity leave for female employees in Beijing who have a miscarriage within four months of pregnancy is 15 to 30 days, and the maternity leave for female employees who have a miscarriage after four months of pregnancy is 42 days.

In Beijing: The Beijing Regulations on Maternity Insurance for Enterprise Employees stipulate that the maternity leave for female employees who have a miscarriage within 4 months of pregnancy is 15 to 30 days, and the maternity leave for female employees who have a miscarriage after 4 months of pregnancy is 42 days.

If a female employee has a miscarriage within 4 months of pregnancy, she should be given 15 to 30 days of maternity leave based on the hospital certificate; if she has a miscarriage during pregnancy between 4 months and 7 months, she should be given 42 days of maternity leave, and if she has a miscarriage during pregnancy over 7 months, she should be given normal maternity leave. Female employees who have had two or more miscarriages and currently have no children should be transferred from jobs that may directly or indirectly cause miscarriage.
